Menurut Dewan Pembina Konsultasi Syariah, suami diperbolehkan untuk menghisap puting istrinya. Hal ini bahkan dianjurkan untuk memenuhi kebutuhan biologis istri seperti suami yang juga menginginkan istrinya memenuhi kebutuhan biologis dirinya.

Apabila saat menghisap puting istrinya, sang suami secara sengaja atau tidak sengaja menghisap ASI. Maka itu hukumnya diperbolehkan.

Para ulama memperbolehkan hal tersebut bila dibutuhkan semacam untuk berobat. Misalnya, bila sang istri mengalami mastitis.

Sebab hisapan orang dewasa lebih kuat dibandingkan bayi sehingga suami seringkali lebih berhasil membersihkan penyumbatan yang terjadi di payudara istri.

Namun bila tidak ada kebutuhan, ulama di kalangan madzhab Hanafi berselisih pendapat. Ada yang mengatakan boleh dan ada yang me-makruh-kan hal itu.

Dalam Al-Fatawa al-Hindiyah (5/355) disebutkan,

وَفِي شُرْبِ لَبَنِ الْمَرْأَةِ لِلْبَالِغِ مِنْ غَيْرِ ضَرُورَةٍ اخْتِلَافُ الْمُتَأَخِّرِينَ كَذَا فِي الْقُنْيَةِ

“Tentang hukum minum susu wanita, untuk laki-laki yang sudah baligh tanpa ada kebutuhan mendesak, termasuk perkara yang diperselisihkan ulama belakangan. Demikian keterangan dalam  al-Qunyah,”

Adapun dalam Fathul Qadir (3/446) disebutkan pertanyaan dan jawaban,

“Bolehkah menyusu setelah dewasa? Ada yang mengatakan tidak boleh. Karena susu termasuk bagian dari tubuh manusia, sehingga tidak boleh dimanfaatkan, kecuali jika terdapat kebutuhan yang mendesak.”

Jadi, dapat disimpulkan bahwa suami sebaiknya mengambil sikap yang lebih tepat dengan berusaha tidak meminum ASI istri. Hal itu dikarenakan masih adanya perselisihan antara para ulama dan perbuatan yang menyelisihi fitrah manusia.

Hukum suami minum ASI istri, apakah dia jadi saudara susuan sang anak?

Ibnu Qudamah dalam kitabnya al-Mughni, mengatakan bahwa suami meminum ASI istri tidak membuatnya jadi mahrom istri atau menjadi saudara sepersusuan sang anak. Karena hukum saudara sepersusuan hanya berlaku bila anak yang menyusu berusia di bawah 2 tahun. Pendapat ini didukung oleh mayoritas ahli fikih.

Allah Swt. berfirman dalam surat al-Baqarah ayat 233, “Para ibu hendaklah menyusukan anak-anaknya selama dua tahun penuh, Yaitu bagi yang ingin menyempurnakan penyusuan.”

Al-Baghawi mengatakan dalam Tafsir al-Baghawi, bahwa dua tahun merupakan batas menyusu bagi seorang anak. Hal Ini menunjukkan bahwa setelah dua tahun tidak berlaku hukum persusuan.

Jadi dalam hal ini suami tidak bisa menjadi anak susuan istri dan lantas merusak ikatan pernikahan.

Hal tersebut juga ditegaskan dalam sebuah hadis yang diriwayatkan oleh Bukhari:

Dari Aisyah RA bahwa suatu ketika saat Nabi Muhammad SAW masuk ke dalam rumah di sampingnya terdapat seorang lelaki. Lalu air muka beliau terlihat berubah seakan ia tidak menyukainya.

Tak lama, Aisyah berkata, “Ia adalah saudara sepersusuanku.” Kemudian Rasul SAW. menimpali, “Perhatikanlah siapa saudara sepersusuanmu itu. Karena sesungguhnya sepersusuan itu karena lapar.”

Hal ini dapat diartikan bahwa hanya bayi yang menyusu karena lapar karena dia belum bisa mengonsumsi makanan padat. Berdasarkan hadis ini, Imam Malik dalam Muwaththa’ berpendapat bahwa hukum persusuan tidak berlaku untuk suami yang hanya ingin merasakan ASI istri tanpa ada kebutuhan yang jelas.

Oleh karena itu, meminum ASI istri tidak merubah status suami menjadi anak susuan sang istri serta tidak otomatis pernikahannya harus dibubarkan dengan dalih suami telah menjadi mahromnya.
